I contacted Van's people and sadly its a no go. I guess global warming is too hot of a topic for Van (pun intended).

I am not a lawyer, but you should consider appealing via YouTube's process if that is still available under the claim of fair use.

If you've got $75, talk to a lawyer for 1/2 hour.

See also article on Weird Al Yankovic at Wikipedia. Al Yankovic does get permission, but as a courtesy, it seems. (Wikipedia is not exactly a lawyer either...)

Your song was really climbing in terms of view count.

You might consider putting another one up, with the sound disabled, and the lyrics in closed captioning....with a banner that repeatedly states "Van Morrison/Exile productions doesn't want you to see this video" constantly scrolling across the screen.
